Referrals are an ethical and beneficial way to see that clients are represented
In 2004, the State Bar of Texas Referral Fee Task Force conducted an in-depth review of attorney referrals. This task force found that referrals do not harm clients and are actually a beneficial means of seeing that clients get the representation they need. The results of the 2004 study led to the drafting of Texas Disciplinary Rules of Professional Conduct Rule 1.04 in 2005, which is the form of the rule applicable to attorney referrals in Texas to this day.
Rule 1.04 requires that any referral is approved by the client in writing. The rules also state that the referring attorney has an ethical duty to see that the client will be adequately represented.
